The following General Terms and Conditions of Sale govern the offer and sale of products on our website ("moimimi.com"). The products purchased on moimimi.com are directly sold by DE FAZIO srl, hereinafter referred to as “the Vendor”, with registered office in Italy at via Astalonga 64, 80047 San Giuseppe Vesuviano (NA), and headquarters in Italy at Via Vicinale dei Cefali–Cuomo, 80044 Ottaviano (NA), tax code 07606221211 and VAT number 07606221211. You will find information on orders, shipping, returns, exchanges, and refunds for products purchased on moimimi.com. 1. Business Policy

1.1 The Vendor offers its products for sale moimimi.com and its e-commerce business services are available exclusively to its end users, the “Customers”.

1.2 “Customer” shall mean any individual who purchases on moimimi.com for purposes which are outside his or her trade, business or profession. If you are not a Customer, please do not buy any products on moimimi.com.

1.3 The Vendor reserves the right not to process orders received from users who are not “Customers” and any order which does not comply with the Vendor’s business policy.

2. How to execute a Contract with the Vendor

2.1 To execute a contract for the purchase of one or more products on moimimi.com, the Customer must fill out the online order form and send it electronically to the Vendor, following the relevant instructions.

2.2 Before proceeding with the purchase of any products through the online form, you will be asked to carefully read the General Terms and Conditions of Sale and the Return Policy, to print a copy through the print option and to save a copy.

2.3 Italian is the language available to Customers in Italy to execute contracts with the Vendor. English is the language available to Customers in EU and non-EU countries to execute contracts with the Vendor.

2.4 After the contract is executed, the Vendor will process your order.

2.5 The Vendor may non process purchase orders when there are not sufficient guarantees of solvency, when orders are incomplete or incorrect, or the products are no longer available. In the above cases, the Vendor shall inform you by email that the contract has not been executed and that the Vendor has not carried out and will not carry out your purchase order, specifying the reasons thereof. If the products displayed on moimimi.com are no longer available at the time of your last access, and once the Vendor has received your order form, the Vendor shall inform you of the of the unavailability of the ordered products as soon as possible and in any case within twenty (20) work days from the day after the Vendor has received your order.

2.6 By submitting the online order form, the Customer accepts and undertakes to observe the provision of these General Terms and Conditions of Sale. Should you not agree with certain provisions of these General Terms and Conditions of Sale, please do not submit your order form for the purchase of products on moimimi.com.

2.7 By submitting the online order form, you agree to and accept these General Terms and Conditions of Sale as well as further conditions contained on moimimi.com.

2.8 Once the contract is executed, the Vendor shall send you a purchase order receipt email.

3.Payments

3.1 It is possible to purchase products on moimimi.com by Credit/Debit Card (through Stripe), Pay Pal or Wire Transfer. In the case of a purchase by Wire Transfer, the Vendor shall communicate the IBAN code for payment during the purchase phase. With this payment method the Customer is responsible for all bank charges. The Vendor reserves the right to ask for a supplement if the amount wired does not correspond with the exact sum total of the order.

4. Shipping and Delivery of the Products

4.1. Shipping Costs in Italy
Shipping in Italy is carried out through the courier TNT.
There are no shipping costs for orders equal to or over 120.00 Euros in Italy, except for specific areas which will be specified upon ordering. For orders under 120.00 Euros in Italy the shipping costs are of 8.00 Euros.
In accordance with the laws that govern that regulate commerce, all deliveries from the website moimimi.com are sent with an invoice which states the value of every item and the total value of the purchase in Euros


4.2 Shipping Costs outside Italy
Shipping outside Italy in EU Countries is carried out through the courier DHL. There are no shipping costs for orders equal to or over 250.00 Euros in the European Union, except for specific areas which will be specified upon ordering. For orders under 250.00 Euros in the European Union the shipping costs are of 15.00 Euros. Shipping outside Italy in Non -EU Countries is carried out through the courier DHL. There are no shipping costs for orders equal to or over 350.00 Euros in the European Union, or the equivalent of this sum in another currency, except for specific areas which will be specified upon ordering. For orders under 350.00 Euros or the equivalent of this sum in another currency, countries outside the EU the shipping costs are of 25.00 Euros. In accordance with the laws that govern that regulate commerce, all deliveries from the website moimimi.com are sent with an invoice which states the value of every item and the total value of the purchase in Euros.

4.3 Shipping Date
All orders received within 12:00 p.m., from Mondays through Fridays will be sent on the same day.

All orders received after 12:00 p.m. will be sent the next day. All orders received from 12:01 p.m. on Fridays and on holidays or the day before a holiday, will be sent on the first available work day.

4.4 Delivery Time
From the day the order is shipped the delivery times are:

  • 1-2 work days in Italy
  • 2-3 work days in Italy for the Islands and specific rural areas
  • 6-7 work days for EU countries
  • 15-20 work days for non-EU countries

4.5 Order Status
Upon shipping the order moimimi.com sends the Customer an e-mail with a tracking number supplied by the courier (TNT for Italy or DHL outside Italy). The clients can follow the status of their packages on the website www.tnt.it for orders in Italy and www.dhl.com for orders outside Italy.

4.6 Insurance of packages
Packages are insured by the Vendor against theft and accidental damage. When the package reaches destination and is delivered the insurance expires. Through signature upon delivery, responsibility of the goods is passed to the buyer. The individual who signs confirms the delivery receipt and is responsible for the package.

4.7 Delivery of the package
At the moment of delivery, the individual who receives the package must carefully inspect it before signing the delivery receipt. The packages prepared by moimimi.com are accurately packed and made with custom branded Moi Mimì containers. If for any reason the package seems tampered with or the branded Moi Mimì tape is not intact, the Customers must sign for delivery conditionally, or to refuse to accept delivery.
In case delivery happens with a package without Moi Mimi logos it has surely been tampered with and the client must refuse it.

In case the package is accepted with an unauthorized signature, or there is proof of tampering, the Customer must immediately report the incident to the local office of the shipper who delivered the package and to inform the Vendor by writing to customer.care@moimimi.it 

4.8 Package Storage
In case of failed delivery of the package for reasons that depend on the Customer, the next day the courier automatically sends the Vendor a dossier of non-delivery of the goods, which reports the reasons for the failed delivery and the request of instructions for release of the goods.

Customer can also access the dossier of non-delivery of the goods and the state of their orders through the websites on the website www.tnt.it for orders in Italy and www.dhl.com for orders outside Italy.
The Vendor reserves the right to request the return after three (3) work days in the absence of instructions and/or news of the final Customer.

A storage period of a maximum of fifteen (15) days at the courier branch closest to the delivery destination.

5. Returns- Refunds- Exchanges

5.1 Information regarding the return policy
The customer can return a product within fourteen (14) days from the reception of the product. Client must inform the Vendor by filling out the return form or exchange form online. Click here to consult the Return Policy.

5.2 Refunds
After the Vendor receives the return and checks that the requirements for the return or the exchange have been met, the Customer receives a confirmation e-mail of accepted return and the refund procedure starts. The times and methods for refunds vary depending in the payment method used by the Customer:

  • Payment by credit/debit card: Reimbursement time depends on the credit/debit card company. The refund value will be the same as the amount charged. The time in which the refund will be visible on the back statement may vary.
  • Payment by PayPal: refunds will be credited to your PayPal account and will be visible immediately. Reimbursement time to the credit card associated with your PayPal account depends on the company that issued the card.

5.3 Exchanges
It is possible to exchange size and/or color of a purchased product only once within fourteen (14) days of the reception of the product.
In case the size and/or the color of the product requested in the exchange are out of stock, the Vendor reserves the right to consider the exchange a return. The Customer will be immediately informed by e-mail and the refund procedure will be started.
In case the size and/or the color of the product requested in the exchange are momentarily out of stock, the Client will be immediately informed by e-mail on the time frame of the shipping for the restocking of the storage. If the times do not meet the needs of the Customer, they have the right to turn the exchange into a refund by contacting the seller at customers.care.cambi@moimimi.it

5.4. Returns
If your delivery address is in Italy the Vendor offers the possibility to use the TNT service for returns and exchange, which facilitates the process and costs 7.00Euros.

The facilitated return and exchange through TNT is only available in Italy, including islands and rural areas.
To access the service, you need to contact the TNT customer service through the link https://mytnt.it/TNTVirtualCode/pricing.html and ask to book a national pick up, specifying the receiver’s information (De Fazio srl, Via Vicinale Dei Cefali-Cuomo, 80044 Ottaviano (NA), the sender information, and the preferred pick up time.

The time frames must be included in the couriers’ working hours and pick-ups will not occur on holidays

The Customer is free to use a different courier at their own expense for an exchange or return, provided that they respect the time of return and exchange of fourteen (14) days.

6. Guarantees and Product Price Indication

6.1 On moimimi.com we only offer products marked by the “Moi Mimì” trademark and are manufactured directly by the Vendor in Italy.

6.2 The Vendor does not sell flawed products or products of lower quality than the corresponding market standards. The Vendor does not sell products used in fashion shows, photo-shoots or in any other way.

6.3 The main characteristics of the products are shown moimimi.com. The products offered for sale on moimimi.com may not exactly correspond to the real garments in terms of image and colors due to the Internet browser or monitor resolution used by the Customer.

6.4 Order requests made from countries not included in the ones specified on the website cannot not be accepted by the Vendor.

6.5 All products sold on moimimi.com is come with an identification tag attached with a disposable seal. You should not remove or alter the tag or seal from the purchased products before you accept the purchase. You will not be able to return the product for refund or exchange products without the tag. The removal of the tag and seal constitute the acceptance of the product.

8. Governing Law

8.1 These General Terms and Conditions of Sale are governed by Italian law and in particular by Italian legislative decree no.206 of 6 September 2005, on distance contracts and by Italian legislative decree 70 of 9 April 2003 on certain aspects related to e-commerce.
